Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Qulture mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

We may update these Terms from time to time. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.

2. Eligibility

You must be at least 13 years old to use Qulture. By using the App, you represent and warrant that you meet this age requirement.

If you are between 13 and 18 years old, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to:

• Provide accurate and complete information when creating your account
• Notify us immediately of any unauthorized use of your account
• Not share your account with others

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Use of the Service

Qulture grants you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes.

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to any part of the service
• Interfere with or disrupt the integrity or performance of the service
• Scrape, crawl, or systematically extract data from the service
• Use the App to transmit spam, malware, or other harmful content
• Impersonate another person or entity

5. Your Content

You retain ownership of any content you create or upload to Qulture, including lists, notes, and media ("Your Content").

By using the App, you grant us a limited license to store, process, and display Your Content solely to provide the service to you. We do not claim ownership of Your Content and will not sell it to third parties.

You represent that you have the rights to any content you add to Qulture and that it does not violate any third-party rights.

6. AI-Powered Features

Qulture uses artificial intelligence to help you organize and discover content. AI-generated suggestions, transcriptions, and categorizations are provided for convenience and may not always be accurate.

By using voice features, you consent to your audio being processed by third-party transcription services (OpenAI Whisper) to generate text. Raw audio is not permanently stored.

AI processing of your content (images, text, voice) is done to provide the App's core functionality. You can disable AI features in Settings.

7. Third-Party Integrations

The App allows you to connect optional third-party services such as Instagram and Spotify. When you connect these services, you are also subject to their respective terms of service and privacy policies.

We are not responsible for the practices of third-party services. You may disconnect any integration at any time from Settings.

8. Intellectual Property

The Qulture app, including its design, features, and underlying technology, is owned by us and protected by copyright, trademark, and other intellectual property laws.

The Qulture name and logo are our trademarks. You may not use them without our prior written permission.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted or error-free
• Any content recommendations will be accurate or suitable for your needs
• The App will be free of viruses or other harmful components

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

11. Termination

You may stop using the App and delete your account at any time from Settings → Account → Delete Account.

We may suspend or terminate your access to the App at any time, with or without cause or notice, including if we believe you have violated these Terms.

Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, and limitations of liability.

12. Governing Law

These Terms are governed by the laws of the United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property disputes.
